PREAMBLE

1. On the one hand, the Company Nais Trading S.L.U. (hereinafter, NAIS), with NIF No. B12913380, registered in the Commercial Register of Castellón (Volume 1625, Folio 168, Page CS-35658, 1st inscription), owner of the website nais.es

2. And on the other hand, any person who places an order (hereinafter, the CLIENT), whose data entered when making the purchase, through the established form, are those that have been consigned by himself. The responsibility for the authenticity of the same corresponds directly and exclusively to the CLIENT.

ARTICLE 1 - PURPOSE

The purpose of these Conditions of Sale is to define the terms and conditions of sale between the CUSTOMER and NAIS, including the placing of the order, delivery and payment.

The placing of an order implies acceptance of these Conditions of Sale by the CUSTOMER, as well as any other conditions specified in the order itself.

Orders will be shipped exclusively within the Spanish territory of the Iberian Peninsula and the Balearic Islands (orders are not shipped to the Canary Islands, Ceuta and Melilla).

Access to information is completely free of charge, while the service of purchasing products is onerous, specifying the current prices of the product, the prices of postage and tax charges.

ARTICLE 2 - ORDER

NAIS offers the CUSTOMER two ways to place an order:

1. By internet, on the website nais.es (24h/day, 365 days a year), following the established procedure.

2. By e-mail: nais@nais.es indicating the items, quantity, delivery address, billing address, name and telephone number of the contact person. In this case the only form of payment allowed will be the bank transfer, and it will be necessary the written acceptance of the generated budget and the sending of the proof of payment (document in pdf or jpg format) to be able to process the order.

To process the order, the CUSTOMER must provide the personal data requested by any of the above procedures.

The realization by the CUSTOMER of the order is equivalent to the full and entire acceptance of the prices, the description of the products for sale and the Conditions of Sale, as well as any other specified in the order itself.

Once the contracting procedure has been completed, the CUSTOMER will receive an e-mail to the address provided at the registration stage, which will show all the information relating to the purchase.

In the unlikely event that it is necessary, NAIS will inform the CUSTOMER, as soon as possible, of the unavailability of the product ordered.

The email will be sent within a maximum period of 24 hours according to the Law. However, since this email is generated automatically, errors may occur that are beyond the control of the Responsible for the website, so please inform NAIS (nais@nais.es)

ARTICLE 3 - DELIVERY

The CUSTOMER will receive detailed information on the delivery dates of the different products. For any questions or clarification, the CUSTOMER may contact NAIS via email (nais@nais.es)

All orders are shipped CARRIAGE DUE, applying the rates indicated on the Shipping Conditions page.

The CUSTOMER will receive the merchandise directly at the address indicated at the time of purchase. The merchandise will always be delivered STREETWARD

Upon receipt of the order, it is mandatory that the CUSTOMER checks that everything is in accordance with your order and in perfect condition. If the CUSTOMER does not agree with the products delivered or their condition, the CUSTOMER must sign and indicate by hand, on the delivery note, the anomalies found in the goods (packaging in poor condition, the packages do not match the delivery note, etc.)

In the event that the CUSTOMER does not receive the material, the transport agency will return it to our facilities. The cost of this return transport will be borne by the CUSTOMER. In the event that the CUSTOMER rejects the purchase, CUSTOMER will be reimbursed the value of the material minus the cost of its return. In the event that the CUSTOMER requests the reshipment of the material, the costs of the previous return will be added to the costs of reshipment.

In case of any incident related to the transport of the goods, the deadline is 24 hours from the date of receipt of the product to complain to the transport company. Once this period has elapsed, the CUSTOMER will be responsible for the transport costs incurred.

If any reference of the products received does not match the one in the confirmation e-mail, the CUSTOMER must contact NAIS via e-mail (nais@nais.es) to correct the error as soon as possible.

On the other hand, with the order confirmation e-mail that the CUSTOMER will receive, the ORDER NUMBER will be provided.

Once the order has been delivered, the CUSTOMER will receive, by e-mail, the corresponding invoice in pdf format. NAIS will keep a digital copy of these invoices. In the event of an error on the invoice, the CUSTOMER may contact NAIS by sending an email to nais@nais.es requesting the correction of the error. NAIS undertakes to correct the error within a maximum of 5 working days.

ARTICLE 4 - PAYMENT

NAIS offers the CUSTOMER five methods of payment for its order.

1) Bank transfer

When selecting the bank transfer as a means of payment, the CUSTOMER will receive, together with the confirmation of his order, an e-mail indicating the account number to which the bank transfer should be made in the name of Nais Trading S.L.U.

It is very important that the CUSTOMER indicates in the concept of the transfer the Order number, as well as his name and surname, and makes the transfer within 3 days after the order confirmation date in order to validate it.

For the order to be processed and prepared for shipment, it is essential that the CUSTOMER sends the proof of the transfer by e-mail to nais@nais.es. This proof must be the .pdf or .jpg document generated by the bank, since any other document is merely informative and not binding. The order will not be prepared until the administration department receives the proof of the bank transfer.

2) Credit or debit card

NAIS guarantees that each and every transaction carried out in nais.es is 100% secure. All transactions involving the transmission of personal or banking data are carried out using a secure environment. nais.es uses a server based on standard SSL (Secure Socked Layer) security technology. All information transmitted to us by the CLIENT travels encrypted through the network

Likewise, the data on the CUSTOMER'S credit card is not recorded in any database, but goes directly to the POS (Point of Sale Terminal) of the Bank.

When paying by card, the CUSTOMER will always be asked for the following data: the card number, the expiration date, and a Validation Code that coincides with the last 3 digits of the number printed in italics on the back of the card, thus offering more guarantees about the security of the transaction.

3) Paypal

ARTICLE 5 - PRICES

All sales prices indicated on the NAIS website are shown in EUROS and include VAT. Shipping costs will depend on the products added to the cart, as these may or may not be included in the price. This will be indicated in each product, and in those cases where shipping costs are not included, these will depend on the weight and delivery address.

NAIS reserves the right to modify its prices at any time. However, it undertakes to apply the current rates indicated on the website, except in the case of error or omission, at the time of placing your order.

If, there being a typographical error in any of the prices or products shown, the CUSTOMER has made a purchase decision based on this error, NAIS will inform the CUSTOMER of this error, and the CUSTOMER will have to either cancel his purchase (at no cost on his part) or adhere to the new conditions and price communicated.

ARTICLE 6 - RETURNS

Tiles (Porcelain and white body)

NAIS will accept returns within 14 days of receipt of the goods by the CUSTOMER, provided that the item has not been explicitly indicated on the product sheet as non-returnable, for which no returns will be accepted.

A CUSTOMER may always return a product for any of the following reasons

  • That the product is defective.
  • That there is an error in the shipment and the reference supplied does not correspond to the one that appears in the order.
  • That the product does not meet the expectations of the CUSTOMER.

The payment of the return shipping costs will vary depending on the reason for the return

  • If the return is due to a defect in the product or a shipping error, the shipping costs will be paid by NAIS.
  • If the return is due to the fact that the product does not meet the CUSTOMER's expectations, the shipping costs will be paid by the CUSTOMER. In this case, either NAIS manages the shipping (but not the payment) of the return through its transport agencies, or the CUSTOMER hires an external agency at its own expense.

Materials already placed are expressly excluded from the possibility of return.

Once the returned goods have been received, the NAIS technical service will check them and, if everything is correct, NAIS will accept the return and proceed to the corresponding credit to the CUSTOMER.

NAIS will only pay the value of the products to be returned (not the associated shipping costs), therefore, the shipping costs will always be paid by the CUSTOMER.

The refund of the amount corresponding to the return will always be made by the same method used by the CUSTOMER in the payment of the initial order.

Grout and anti-skid liquid

NAIS will not accept returns on grout and anti-slip liquid products, as these are made to order as they are customized/special.

A CUSTOMER may return a product within 14 days of receipt for any of the following reasons:

  • That the product is defective.
  • That there is an error in the shipment and the supplied reference does not correspond to the one that appears in the order.

The payment of the return shipping costs will vary depending on the reason for the return:

  • If the return is due to a defect in the product or a shipping error, the shipping costs will be paid by NAIS.

Materials that have already been installed are expressly excluded from the possibility of return.

Once the returned goods have been received, the NAIS technical service will check them and, if everything is correct, NAIS will accept the return and proceed to the corresponding credit to the CUSTOMER.

ARTICLE 7 - WARRANTIES and CLAIMS

All products sold on the website nais.es are guaranteed for TWO YEARS.

If the CUSTOMER needs to make use of his right to warranty, he must contact NAIS by e-mail nais@nais.es will inform the CUSTOMER about the steps to follow for the quick solution of the incident.

The CUSTOMER will not be able to make use of the warranty in case of defects and deterioration due to external circumstances, accidents, and installation and use of the products not in accordance with the instructions. Also excluded from the warranty are products modified or repaired by the CUSTOMER or any other person not authorized by the manufacturer.

No claims will be accepted on material already installed.

ARTICLE 8 - PRIVACY AND LIABILITY POLICY

NAIS guarantees that the processing of personal data will be carried out under security levels that prevent their loss, manipulation or unauthorized access. In compliance with the provisions of Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights and to REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, NAIS informs that all data provided by the CUSTOMER, by any means, through the order form, the catalog request, and throughout the commercial relationship, will be incorporated into a file whose owner and responsible is NAIS and will be treated with the utmost confidentiality. The purpose of the collection and processing of data is to manage the business relationship, manage requests and/or orders and their collection and, likewise, to carry out processing for advertising and commercial prospecting purposes.

These data will be kept as long as the deletion is not requested by the interested party and may be transferred and/or communicated to collaborators/third parties in order to solve and meet the needs of the CUSTOMER, as well as to offer related services.

At any time the CLIENT may exercise their rights of access, rectification, deletion, portability, limitation or opposition to the processing of their data, as well as withdraw the consent given or make claims before the Control Authority. These actions may be exercised by sending the request by email to nais@nais.es

NAIS cannot be held responsible for any consequences that may result from the improper use of the products sold on its website.

In the event that websites owned by NAIS host banners that allow the user to access web pages or links owned by third parties, NAIS is not responsible for the content that may be hosted therein and will proceed to remove them in the event that any user communicates any type of illegal content, once verified.

ARTICLE 9 - INTELLECTUAL PROPERTY

All the elements of the website nais.es her visual or audio, including the underlying technology, are protected by copyright, trademarks or patents

ARTICLE 10 - ENTIRE AGREEMENT

The present Conditions of Sale constitute the entire agreement between the parties concerned.

In the event that one of the clauses of the present Conditions is null and void, this shall not affect the rest of the conditions.

ARTICLE 11 - APPLICABLE LAW AND JURISDICTION

These Conditions of Sale shall be interpreted and governed by the Spanish legislation in force.

For the resolution of any doubt, discrepancy or divergence that may arise in the performance and interpretation of this Contract, the parties submit to the Courts and Tribunals of Castellón. However, this shall not prevent NAIS from exercising the right to resolve any dispute in another competent jurisdiction.
